ELIZABETH—A Wirt County municipal entity filed suit against a farm operation and its owners, claiming breach of contract in an alleged 2013 loan default.
Mid-Ohio Valley Regional Planning and Development Council of Parkersburg filed a complaint against Nature’s Bounty Farms LLC, Brian L. Bellew, and Alicia M. Bellew, all of Brohard, on June 23 in Wirt Circuit Court asserting breach of contract in an alleged failure to repay debt of an original 2013 loan.
The suit states that plaintiff serves as fiscal agent for Little Kanawha Area Development Corp. According to the filing, the defendants executed a promissory note to Little Kanawha on Nov. 22, 2013, in the amount of $35,000 with an agreement to make 72 monthly payments; including a guaranty of payment contract.
The suit states that the defendants are in arrears as of Oct. 21, 2014; and having breached the agreement, have been unjustly enriched through the use of farm equipment purchased with the loan.
Property purchased with the loan proceeds included items such as a four-wheel drive tractor, equipment and livestock trailers, poultry processing equipment, and a hay wagon.
According to the complaint, the plaintiff is entitled to recover $30,706.56 plus interest, attorney’s fees, and costs.
The plaintiff is represented by Leslie L. Maze of Elizabeth. The case has been assigned to Judge Robert A. Waters.
