Gillmann Services sues Charleston Hotel Venture for failure to pay

CHARLESTON - Gillmann Services Inc. is suing Charleston Hotel Venture LLC after it claims the company failed to pay for services and labor.

Vic of WV LLC was also named as a defendant in the suit.

Gillmann Services provided labor and services from Dec. 22, 2013, until June 1, 2014, totaling $80,835.60, in connection with the construction of the Charleston Marriott, according to a complaint filed May 18 in Kanawha Circuit Court.

Gillmann claims it has substantially completed all work and performed under its contracts with the defendants and the sub-contractor, Hi-Tech Electric Inc.

Hi-Tech subsequently filed for bankruptcy protections and failed to pay Gillmann for the services it performed, according to the suit.

Gillmann claims the defendants have been unjustly enriched at Gillmann's expense and it is entitled to recover from them the money they have been unjustly enriched.

The plaintiff has made several unsuccessful attempts to collect the amount owed from the defendants, according to the suit.

Gillmann is seeking judgment for an amount of money which will fairly compensate it for each element of damages recoverable by it against the defendants with pre- and post-judgment interest. It is being represented by Michael S. Bailey of Bailey & Howard.

The case is assigned to Circuit Judge Louis Bloom.
