HUNTINGTON – A Kentucky woman is suing the Cafero Company and Warner Management Co. Ltd. for injuries she sustained while she was walking through the Huntington Mall.
On Sept. 9, 2013, Debbie J. Blanton was walking down a concourse at the Huntington Mall near the Fox apparel store, according to a complaint filed July 10 in the U.S. District Court for the Southern District of West Virginia.
Blanton claims she was unaware that there was water or other clear foreign substances on the floor when she was walking through the mall.
The defendants allowed the water or clear foreign substance to accumulate on the floor in the area where Blanton was walking, causing the floor to be wet and slippery, according to the suit.
Blanton claims the defendants failed to place cones or other warning devices in the area so to put the plaintiff and the rest of the public on notice of the latent wet and slippery floor condition.
As Blanton traversed the area, she slipped and fell on the water and suffered left foot injuries and right knee injuries, according to the suit.
Blanton claims the defendants had a duty of reasonable care to non-trespassing entrants and invitees to keep the premises free of hazards.
The defendant negligently failed to provide reasonable care to invitees and negligently failed to keep the premises free of hazards, according to the suit.
Blanton is seeking compensatory and punitive damages with pre- and post-judgment interest. She is thinking Brian L. Ooten of Shaffer & Shaffer; and Kyle R. Salyer of Salyer Law Office PLLC.
The case is assigned to District Judge Robert C. Chambers.
