CHARLESTON - A Charleston man is suing Big Sandy Furniture after he claims he was attacked by an employee.
Kevin Gaten was also named as a defendant in the suit.
On Aug. 6, 2014, Kenneth Ray Mullins was physically attacked and brutally beat by Gaten, who was an employee at Big Sandy, according to a complaint filed June 22 in Kanawha Circuit Court.
Mullins claims on Dec. 10, Gaten pled guilty to the misdemeanor offense of battery in Charleston Municipal Court.
Gaten's negligent, willful, wanton and reckless misconduct caused Mullins to incur medical expenses and severe pain and suffering, according to the suit.
Mullins claims Gaten's actions were intentional and caused Mullins to be battered.
Big Sandy is vicariously liable for the misconduct of an employee acting within the scope of employment, according to the suit.
Mullins claims Bi Sandy had a duty to provide sufficient training and supervision of its employees.
Big Sandy breached its duty of care and caused substantial injuries and damages, according to the suit.
Mullins is seeking compensatory and punitive damages with pre- and post-judgment interest. He is being represented by Mark S. Plants of Plants Law Offices.
