Woman sues Marshall University for soccer injuries

HUNTINGTON - A woman is suing Marshall University Board of Governors after she claims she was injured while playing in a soccer game.

Southern Prosthetic Supply Inc. was also named as a defendant in the suit.

On Sept. 14, 2014, Marshall University directed Taylor Fleming to wear the Southern Prosthetic Supply face guard safety shield in a soccer game to protect her face, according to a complaint filed in Cabell Circuit Court.

Fleming claims the shield was hit by a soccer ball and it broke, shattered and cracked, which caused it to tear and rip into her face.

As a result, Fleming suffered bleeding, lacerations, scarring and permanent disfigurement, according to the suit.

Fleming claims the defendants' negligence caused her to suffer physical pain and suffering; mental anguish; physical impairment; medical expenses; physical disfigurement and inconvenience; and embarrassment and humiliation.

The defendants failed to properly inspect, store, maintain and protect the face guard safety shield before providing it to athletes.

Fleming is seeking compensatory damages with pre- and post-judgment interest. She is being represented by Mark F. Underwood of Underwood Law Office.

The case is assigned to Circuit Judge F. Jane Hustead.
