Coal miner sues after allegedly suffering head injuries on job site

LOGAN – A McGraws man is suing his employer for damages related to an alleged head injury he incurred while in the course of employment.

Richard Lester filed suit against Alpha Natural Resources Inc., Aracoma Coal Co. Inc., and Quality Fab LLC in Logan Circuit Court on May 27.

According to the suit, plaintiff was working for Quality Fab on July 1, 2013, in Alpha's Aracoma Alma No. 1 mine when he was directed to clean the mine where the roof had fallen in. He was asked by his section boss to back a pin man to ensure nothing fell on him but was subsequently struck in the head by a fallen rock. As a result, Lester allegedly sustained severe injuries to his head that resulted in swelling, post-concussion syndrome, lacerations, memory loss and headaches.

The defendants are accused of failure to provide a reasonably safe place to work, having knowledge of the dangers of the work site and failing to regulate those conditions in accordance with the law.

Lester is seeking relief for pain and suffering, permanent physical impairment, loss wages, medical expenses, loss of enjoyment of life, annoyance and inconvenience. He is represented by Tammy Bowles Raines of Tammy Bowles Raines PLLC in Charleston. This case is assigned to Circuit Judge Susan Perry.
