Webster Nursing and Rehabilitation Center sued over alleged negligence, abuse

CHARLESTON – A Nicholas County resident is suing a nursing home on behalf of her mother, claiming neglect in her care.

Donna Flanagan, power of attorney for Gladys Ramsey, filed suit in Kanawha Circuit Court on Sept. 15 against the city of Summersville, doing business as Summersville Regional Medical Center; Webster Nursing and Rehabilitation Center LLC, doing business as Webster Nursing and Rehabilitation Center; and Wisteria LLC, citing negligence, statutory violations and reckless misconduct.

According to the complaint, Ramsey was a resident of the Webster facility from Aug. 27, 2014, to the time of the filing. The complaint states that defendants failed to properly monitor her and negligently permitted her to fall while she was under its care, as well as failed to provide a safe environment.

Flanagan is seeking compensatory damages, punitive damages and attorney fees. She is represented by Andrew L. Paternostro of The Bell Law Firm in Charleston. The case has been assigned to Circuit Judge Carrie L. Webster.
