WHEELING, W.V. -- A real estate company that owns property in Wheeling, West Virginia is suing the property's neighbors for hindering court-ordered demolition. 

Ohio Valley Realty Co. filed a lawsuit on Sept. 3 in Ohio Circuit Court against Mccoy Wealth Management, LLC; Tim Roberts; Grove & Delk, PLLC; and the city of Wheeling, alleging they are hindering the company from completing necessary demolition on its own property.

The real estate company said in the suit that it is working to comply with a court order to demolish buildings at 50 and 52 15th St., but continues to receive resistance from surrounding property owners and leasees. Ohio Valley alleges that it has found replacement parking for surrounding property and offered monetary compensation of $1,500 per month for any inconveniences incurred during demolition of its property, but the defendants allegedly have rejected its offers. In addition, they allegedly have threatened demolition contractors with trespassing charges if they enter their property. 

Ohio Valley Realty is seeking an order to permit its contractors on neighboring property and to temporarily use the property for the purpose of demolishing the structures on its own land. The plaintiff also is requesting that the court determine reasonable compensation for the defendants. Ohio Valley is represented by Frank X. Duff of Schrader Byrd, & Companion, PLLC  in Wheeling.
