Man claims mobile home delivered with water damage, sues Charleston Home Center

RIPLEY – A Jackson County man claims a mobile home he purchased was delivered with severe water damage.

Christopher Landfried filed a lawsuit on Nov. 6 in Jackson Circuit Court against Charleston Home Center Inc. and Triad Financial Services Inc., citing breach of express warranties, implied warranties and warranty of fitness and breach of contract and duty of good faith, negligence and other counts.

Landfried claims he purchased a mobile home along with all contractual warranties from the company in January. Landfried alleges that before or during the delivery and installation the home was severely damaged, and that water persisted to pour throughout the home for two subsequent weeks, causing even more damage. Landfreid claims he contacted the company and refused to accept the home because of its defect, but was told by the company he had to accept the home as stipulated in the contract even though he claims the home warranty should cover the damage. The complaint states that a state inspector found multiple violations of state code with the home.

Landfried is seeking that the contract with the company be canceled, the company be ordered an injunction to stop this behavior from happening again, that he be awarded damages for money lost, emotional distress, loss of use, aggravation, anxiety, annoyance and inconvenience, as well as consequential and incidental damages, attorneys' fees and costs, and any other relief the court sees fit.

Landfried is represented by Kristina Thomas Whiteaker and David L. Grubb of The Grubb Law Group in Charleston. The case has been assigned to Circuit Judge David W. Nibert.
