HUNTINGTON – A Kenova woman suing estate of deceased Huntington woman claiming her fall could have been prevented.
Patricia Hodge filed a lawsuit on Oct. 30 in Cabell Circuit Court against Martha Schlegel, executor of the estate of Clara Schlegel, claiming she was startled and injured because of Clara Schlegel's actions.
Hodge claims that on Nov. 2, 2013, she was lifting Clara Schlegel's sister, Betty, when she turned and was startled by Schlegel who was standing behind her, she claims she then fell and fractured her shoulder. Hodge claims she required medical treatment for her injuries.
Hodge is seeking judgment in an amount equal to an excess of jurisdictional limits, costs and attorneys' fees, and any other relief the court sees fit. Hodge is represented by Donald R. Jarrell of Wayne. The case has been assigned to Circuit Judge Chris Chiles.
