HUNTINGTON – Holiday Inn & Suites being sued by a former employee who claims he was terminated due to his age and is still owed wages.
David Burke filed a lawsuit on Oct. 20 in Cabell Circuit Court against Uptowner Inns Inc., which operates Holiday Inn Hotel & Suites in Cabell County, citing violations of the West Virginia Wage Payment and Collection Act and the West Virginia Human Rights Act.
Burke, 55, claims that he was an employee of the company from Jan. 2, 2013, until his termination on July 1, but has yet to be paid for completed work prior to termination. He also alleges that he was unlawfully terminated because of his age.
Burke is seeking payment in the amount of lost wages, back-pay, interest, and liquidation damages,as well as compensatory damages for embarrassment, emotional distress, and mental anguish, attorneys fees and costs, and any other relief the court sees fit. Burke is represented by J. Michael Ranson and Cynthia M. Ranson of Ranson Law Offices in Charleston and G. Patrick Jacobs of Jacobs Law Office, also in Charleston. The case has been assigned to Circuit Judge Christopher D. Chiles.
