Woman files lawsuit over Wyoming County accident

PINEVILLE – A woman is suing a construction equipment supplier and two West Virginia men over injuries she sustained in two vehicle collisions.

Cynthia R. Mullens filed a lawsuit Dec. 8 in Wyoming Circuit Court against Andy W. Stewart, Carter Machinery Co., and Roy J. Cook, alleging negligence and vicarious liability.

On Jan. 2, 2014, the suit states, Mullens was driving a 1999 Chevrolet Venture Van northbound on W.Va. 16 near Welch, when Stewart, driving a Carter Machinery-owned 2005 Chevrolet Silverado southbound on W.Va. 16, failed to maintain control of his vehicle and traveled left of center into Mullens' lane and struck her vehicle.

A man driving a 2009 Chevrolet Silverado then stopped near Mullens' vehicle. At this time, Cook, driving a 2007 Ford Expedition southbound, crossed the center line and struck both Mullens' vehicle and the vehicle of the man who stopped near her, the complaint states.

Mullens, who was in the process of exiting her vehicle through the passenger door, was knocked from her vehicle at the time of the second impact.

As a result, Mullens suffered severe bodily injuries for which she has incurred medical expenses. She also sustained pain and suffering, physical limitations, loss of capacity to enjoy life, loss of wages, annoyance and inconvenience, and other damages, according to the suit.

Mullens seeks compensatory and punitive damages, plus interests, attorney fees and costs of the suit.

She is represented by attorneys Robert D. Cline, Brian E. Bigelow and Jennifer Dempsey Meeteer of Farmer Cline & Campbell in Beckley. The case has been assigned to Circuit Judge Warren R. McGraw.
