ST. MARYS – A West Virginia equipment company is suing an Ohio oil and gas company over an unpaid balance for goods and services provided.
Leslie Equipment Co. filed a lawsuit Dec. 2 in Pleasants Circuit Court against Triad Hunter, alleging breach of contract and unjust enrichment.
On June 22, 2010, the suit states, Triad Hunter applied for credit with the plaintiff to rent equipment, receive service and purchase parts. Triad Hunter agreed to an annual finance charge of 18 percent of any unpaid balance. Triad Hunter then rented equipment, received service, and purchased parts from Leslie Equipment in an amount of $44,403.65.
The suit states that as of Nov. 2, Triad Hunter had failed to pay the above balance, despite Leslie Equipment notifying Triad Hunter that it is in default on its account and incurring interest and collection costs.
Leslie Equipment seeks to recover the amount owed plus interests, collection costs, and attorney fees. The plaintiff is represented by attorney Jason S. Hammond of Bailey & Wyant in Charleston. The case has been assigned to Circuit Judge Timothy Sweeney.
