Woman claims injuries in suit against Wardensville store

Icefall

MOORFIELD – A Hardy County woman is suing a grocery store after she allegedly was injured when she slipped and fell.

Plaintiff Patricia Brill filed a lawsuit on Jan. 19 in Hardy Circuit Court against Kerr’s Sales and Services Inc. over claims that the defendant was negligent and failed to properly maintain its property, causing her to fall.

On Jan. 20, 2014, Brill was shopping at the defendant’s store in Wardensville when she allegedly slipped and fell on loose carpeting that had been placed directly in front of the entrance. She claims she was hurt in the fall, including injuries to her neck, leg, knee and back. Brill claims that the condition of the defendant’s property constituted a safety hazard to the public. Brill allegedly had to undergo hospital treatments and will incur future treatments; and claims that the fall led to a diminished capacity to enjoy life.

She is suing for compensation for all of her alleged injuries and damages. She is seeking a jury trial and is represented by Lawrence E. Sherman of Romney.
