Waste service claims Clancy's Irish Pub hasn't paid

KEYSER – A Maryland-based waste disposal company is suing an Irish pub in Keyser, alleging it failed to pay for services rendered. 

Western Maryland Waste Systems LLC, doing business as Advanced Disposal, filed a lawsuit on Jan. 11 in Mineral Circuit Court against Michael Brothers Enterprises LLC, doing business as Clancy’s Irish Pub, to recover the balance allegedly owed.

The plaintiff claims that it rendered certain waste disposal services under the terms of a three-year agreement, with specific provisions in the event the agreement was prematurely terminated due to default. On Aug. 20, 2015, the lawsuit states, the plaintiff sent a written notice to the defendant regarding its alleged default in payment of $1,864. The balance eventually rose to $3,648 with liquidated damages, according to the lawsuit.

The plaintiff is suing for $4,560, with a calculation of 18 percent per annum interest. In addition, the plaintiff is asking for attorneys' fees, costs of the suit and any other relief deemed just by the court. The plaintiff is represented by John R. Keating from Amato Keating and Lessa P.C. in Bethlehem, Pennsylvania.
