Putnam County woman alleges companies tried to collect debt that has been paid in full

WINFIELD – A resident of Putnam County is suing debt collectors for allegedly trying to collect more money after she claims she paid the debt in full.

Hollie Hebb Thompson filed a lawsuit Jan. 29 in Putman Circuit Court against Ford Motor Credit Co. LLC, Mapother and Mapother PSC Inc., and Fenton and McGarvey Law Firm PSC, citing violation of West Virginia Code and the West Virginia Consumer Protection Act.

According to the suit, the defendants filed a civil action in the Kanawha Circuit Court in 2005 against Thompson in an attempt to collect a consumer debt. The civil action was fully compromised and settled with the alleged debt being paid in full and was satisfied, the suit states.

Despite the debt being paid, the defendants continued to try to collect the debt, Thompson alleges. Through this action, the defendants knew or should have known Thompson did not owe the alleged debt anymore and their attempts to collect is an unfair and unconscionable manner in violation of West Virginia Code 46A-2-128, the suit states.

Through a jury trial, Thompson is seeking the court to enter judgment against the defendants and award damages to her in an amount to be determined by the trial. Thomas H. Peyton of Peyton Law Firm in Nitro will represent the plaintiff. The case has been assigned to Circuit Judge Phillip M. Stowers.
