KINGWOOD – A Webster County company is suing Mountain Top Logging and its owner to collect an alleged unpaid debt.
Leslie Equipment Co. filed a lawsuit on Jan. 29 in Preston Circuit Court against Joshua Delsignore, individually and doing business as Mountain Top Logging, alleging breach of contract.
According to the complaint, Delsignore signed a credit agreement with Leslie Equipment on Sept. 10, 2013 to rent equipment, receive service and purchase parts. The suit says the terms of the original agreement established finance charges on unpaid balances at 1.5 percent monthly, or an 18 percent annual interest rate.
As of Dec. 2, 2015, Leslie Equipment claims it is owed more than $13,000, which the defendant has refused to pay.
Leslie Equipment seeks damages in excess of $13,348, plus interest and collection and litigation costs. It is represented by Charleston attorney Jason S. Hammond of Bailey & Wyant PLLC. The case is assigned to Circuit Judge Lawrance S. Miller Jr.
