HUNTINGTON – A woman is suing a Huntington physician for professional negligence after she was injured during surgery.
On Dec. 31, 2013, Lora Dotson presented to Dr. Brian Bower for a robotic assisted total laparoscopic hysterectomy and bilateral salpingo-oophorectomy, according to a complaint filed Jan. 14 in Cabell Circuit Court.
Dotson claims during the procedure, Bower placed a suture in her right ureter, which caused right hydronephrosis and complicated urinary tract infection, which required hospitalization and repeat surgery for removal of the suture and placement of a right ureteral stent.
Bower negligently provided medical care to Dotson and failed to exercise a degree of care, skill and learning required of or expected of a reasonable, prudent healthcare provider in the profession or class to which he belonged acting in the same or similar circumstances, according to the suit.
Dotson claims the deviations from the standard of care committed by Bower included failing to identify the ureter at any time during the hysterectomy and failing to recognize a ureteral injury occurred during the robotic assisted hysterectomy and bilateral salpingo-oophorectomy.
As a direct and proximate result of the defendant’s negligence, Dotson required readmission to the hospital for additional testing, required evaluation and treatment by urology to remove the suture and suffered pain, discomfort, physical limitations and was otherwise greatly injured and damaged, according to the suit.
Dotson is seeking compensatory damages. She is being represented by Larry O. Ford of Meyer, Ford, Glasser & Radman PLLC.
The case is assigned to Circuit Judge Christopher Chiles.
