Insurer sues Elite Cleaners over alleged elevator damage

LOGAN – A West Virginia corporation is suing Elite Cleaning Services for damage they allegedly caused to a building the corporation insures.

Farmers & Mechanics Mutual Insurance Company Inc., as subrogee of Jackie Tomblin, filed a lawsuit Feb. 2 in Logan Circuit Court against Elite Cleaning Services, alleging negligence and property damage liability.

According to the complaint, the plantiff’s insured, Jackie Tomblin, owns and operates a rental building in Logan. On Feb. 28, 2014, employees of Elite Cleaning allegedly caused $13,990 worth of damage to the building’s entry and elevator doors. The damage is covered by Tomblin’s policy, less a $500 deductible.

The plaintiff seeks a jury trial and damages of $13,990 to cover the doors and the deductible. It is represented by attorneys Jeffrey D. Van Volkenburg and Stanley A. Heflin III of McNeer, Highland, McMunn and Varner L.C. in Clarksburg.
