WINFIELD – A man is suing 21st Mortgage Corp., claiming it violated consumer protection laws by allegedly harassing him to collect a debt.

Jeff Hartley filed the lawsuit Feb. 25 in Putnam Circuit Court against the financial company, citing common law negligence, intentional infliction of emotion distress and other counts.

According to the complaint, once Hartley fell into arrears on his mortgage, the defendant began a campaign of placing numerous allegedly harassing telephone calls to him at home. The suit claims this conduct intentionally caused emotional distress and violated the West Virginia Consumer Credit and Protection Act and other statutes prohibiting telephone harassment.

Hartley seeks a jury trial and punitive and compensatory damages, plus litigation fees. He is represented by attorneys Daniel K. Armstrong and Benjamin Sheridan of Klein & Sheridan LC of Hurricane. Judge Phillip M. Stowers is assigned to the case.
