Homeowner blames Tudor’s Biscuit World for sewage backup

CHARLESTON — A Kanawha County man says his home was damaged by a sewage backup allegedly caused by improper drainage at a nearby restaurant.

Travis Cox filed a lawsuit Feb. 4 in Kanawha Circuit Court against Better Foods Inc. and Oshel Craigo, alleging fraud, negligence, unreasonable use and nuisance.

According to the complaint, Cox’s real and personal property were damaged during a Feb. 21, 2015 sewage backup allegedly caused by a missing grease trap at the defendant’s Tudor’s Biscuit World in Malden. The suit says sewer officials warned the restaurant about the need for a grease trap, but a two-foot buildup of grease in the sewage pump caused sensors and pumps to malfunction, causing residences on Kanawha Boulevard and Riverlane Drive to flood.

Cos seeks a jury trial and punitive and compensatory damages, plus legal fees. He is represented by attorney Joseph H. Spano Jr. of Pritt and Spano PLLC in Charleston.

Judge Joanna Tabit is assigned to the case.
