Loan guarantor accuses bank of violating privacy

WHEELING – An Ohio County real estate firm and its owners is suing a bank in a dispute involving an alleged unpaid debt.

Dlesk Realty & Investments LLC, Rosalie Dlesk and Randall J. Dlesk filed a lawsuit March 7 in Ohio Circuit Court against Huntington Bankshares Inc., doing business as Huntington National Bank, and CDC Distributors Inc., alleging negligence by violation of the state of Ohio’s Rules of Civil Procedure.

According to the complaint, Randall Dlesk personally guaranteed a loan John James was given by CDC Distributors. When James defaulted, the suit says CDC Distributors subpoenaed Huntington Bank for personal financial details about James and Dlesk. Huntington Bank allegedly honored the subpoena without telling Dlesk and disclosed his Social Security number and other personal information without authorization.

The plaintiffs seek a jury trial and damages of less than $75,000. They are represented by attorney Bradley K. Shafer of Swartz Campbell LLC in Wheeling. Judge James P. Mazzone is assigned to the case.
