Shopper blames store for alleged slip-and-fall injuries

CHARLESTON – A Kanawha County couple is suing Family Dollar Store for injuries the wife allegedly suffered while visiting one of its stores.

Lenora Horton and Arthur Horton filed a lawsuit March 18 in Kanawha Circuit Court against Family Dollar Stores of West Virginia Inc. and an unnamed defendant, alleging negligence and premises liability.

According to the complaint, Lenora Horton suffered injuries from a fall while shopping at the Family Dollar on West Virginia Street on May 25, 2014. The suit says Family Dollar and its store manager – the unnamed defendant – are liable for her injuries because they failed to make the store safe for customers. As a result of her injuries, Horton says she lost wages, incurred medical expenses and suffered emotional distress.

The Hortons seek punitive and compensatory damages in an amount to be determined at trial, plus litigation costs. She is represented by attorneys D. Adrian Hoosier II and Erica Lord of Lord Hoosier PLLC in Charleston.

Judge Tod J. Kaufman is assigned to the case.
