Woman accuses mother’s nursing home of negligence

BECKLEY – A Raleigh County woman is suing a nursing facility over claims that her mother suffered injuries and damages as a resident.

Arlene Toler, on behalf of Rose Mary White, filed a lawsuit April 7 in Raleigh Circuit Court against Jackie Withrow Hospital, administrator Angela Booker, John Does 1-10, and unidentified entities 1-10, alleging negligence, premises liability, fraud, medical malpractice and violation of consumer credit protection laws.

According to the complaint, after White became a resident at Jackie Withrow Hospital in November 2010, she suffered several falls, fractures and infections requiring medical treatment. The suit says White suffered catastrophic injuries, disfigurement, extreme pain and mental anguish, causing deterioration of her overall condition. The plaintiff claims Withrow’s management was aware the facility was allegedly understaffed, but allowed the alleged neglect and abuse to continue.

Toler seeks a jury trial and compensatory and actual damages. She is represented by attorneys James B. McHugh, Michael J. Fuller Jr., Kendra R. Fokakis and Ka’Leya Q. Hardin of the McHugh Fuller Law Group PLLC in Hattiesburg, Mississippi. Judge Robert A. Burnside Jr. is assigned to the case.
