Homeowners accuse bank of breach of mortgage contract

LOGAN – A Logan County couple's lawsuit against their bank seeks to block foreclosure after a layoff.

Larry Pridemore Jr. and Katrina Pridemore filed a lawsuit April 8 in Logan Circuit Court against Logan Bank & Trust Co., alleging breach of contract.


According to the complaint, the Pridemores struck a deal with Logan Bank in 2000 to assume the mortgage of a family member who was unable to make the payments. Once Larry Pridemore’s income dipped after a 2015 layoff, the suit says, the couple sought a loan modification with Logan Bank.

The bank allegedly refused the modification request, and stated the Pridemores still owe some $20,000 on the original loan amount of $26,480, despite receiving steady monthly payments for 15 years. The plaintiffs claim their payments have been misapplied, but say they have been unable to obtain a statement of account.

 

The Pridemores seek civil penalties, actual damages and litigation costs. They are represented by attorney Gary M. Smith of Mountain State Justice in Charleston.
