CHARLESTON – A company accused of wage fraud by an employee wants to move the case from Wood Circuit Court to federal court.
The petition was filed April 15 in U.S. District Court for the Southern District of West Virginia, Charleston Division.
In the original case, Charles M. Robinson II filed a lawsuit against Central Environmental Services LLC, alleging violations of both the Fair Labor Standards Act and the West Virginia Human Rights Act.
Robinson claims Central Environmental Services failed to pay him for overtime hours he worked, and that he was allegedly terminated for informing a company officer of his plays to file a complaint seeking reimbursement.
Central Environmental says the dispute falls under federal jurisdiction because the state and federal laws at issue are related to each other in this case.
Robinson seeks a jury trial and punitive and compensatory damages, plus litigation costs. He is represented by attorneys Jane E. Peak and Nicholas P. Parker of Allan N. Karlin & Associates in Morgantown.
