Ashlee C. Lewis and Laramy T. Lewis were married in Jackson County on March 16, 2015, according to a complaint filed April 21 in Jackson Circuit Court.
Ashlee Lewis claims at the time of the voidable marriage entered into on March 16, 2015, Laramy Lewis was aware of Ashlee Lewis’ current marriage to Geoffery Charles Morgan, but induced her to enter into a marriage by threats to take her infant child from her.
Huxlee Gray Lewis was born to Ashley Lewis on Jan. 3, 2014, in Kanawha County. The child was presume to be the child of Ashlee Lewis’ marriage to Geoffery Morgan and on Feb. 6, 2015, Laramy Lewis selected a forum to litigate all paternity and parenting time issues when he filed a motion for full custody in a paternity action.
On March 31, 2015, Kanawha Family Judge D. Mark Snyder entered a final paternity and dismissal order, which resolved the issue of paternity of Huxlee Lewis, but left the issue of custody pending and unaddressed, according to the suit.
Ashlee Lewis claims that both parties having plead that the marriage was voidable and that the court should enter an order of nullity declaring this voidable marriage to be void.
The plaintiff and all witnesses in the case reside in Kanawha County and that upon entry of the order of nullity, Jackson Circuit Court should no longer have jurisdiction and venue would be proper in Kanawha Family Court, according to the suit.
Ashlee Lewis is seeking that Jackson Family Court be prohibited from conducting any further hearings in regard to the parenting and custodial allocation of the infant child; that the order of nullity previously presented by entered; and that any issues regarding the parenting issues as relates to the parenting and custodial time with infant child be transferred to Kanawha Family Court.
