Borrowers accuse Discover Bank of improper collection attempts

HUNTINGTON — Two West Virginia residents are suing Discover Bank, a financial services company, alleging violation of the West Virginia Consumer Credit and Protection Act.

Joseph and Ashley Osborne filed a complaint on April 19 in Cabell Circuit Court against Discover Bank, alleging that the financial services company continued to contact the plaintiffs to collect a debt despite being notified to communicate with the plaintiffs' legal counsel.

The plaintiffs seek actual damages; statutory damages; cost of litigation including, but not limited to, attorney fees and court costs; general damages; punitive damages; and any other relief the court shall deem proper under the circumstances. They are represented by Matthew P. Stapleton and Scott G. Stapleton of Stapleton Law Offices in Huntington.
