Borrowers say Wells Fargo violated collection law

HUNTINGTON — Two borrowers are suing Wells Fargo Financial National Bank, a financial services company, citing alleged violation of the West Virginia Consumer Credit and Protection Act.

Jared and Victoria Baldwin filed a complaint on April 21 in Cabell Circuit Court, alleging that Wells Fargo failed to comply with the plaintiffs' preference to communicate with their legal counsel with regard to a debt.

According to the complaint, the plaintiffs allege that they fell into arrears on a loan from the defendant, which continued to contact them for collection even after being notified that the plaintiffs had secured legal counsel who should have been contacted instead.

The plaintiffs seek actual damages; statutory damages; cost of litigation including, but not limited to, attorney fees and court costs; general damages for the defendant's negligence; general damages for the defendant's conduct; punitive damages for the defendant's conduct; and any other relief the court shall deem proper under the circumstances. They are represented by Matthew P. Stapleton and Scott G. Stapleton of Stapleton Law Offices in Huntington.
