CHARLESTON — A Kanawha County resident is suing NGK Spark Plugs Inc., a spark plug manufacturer and seller, claiming she tripped and fell at work, resulting in an injury, and then was fired in part because she filed for workers' compensation benefits.
Nora Leann Hutton filed a complaint on May 6 in Kanawha Circuit Court against NGK Spark Plugs Inc. alleging that the spark plug manufacturer and seller wrongfully terminated her employment on April 18, following her Feb. 24 workplace injury and a subsequent attempt to secure workers' compensation benefits.
The plaintiff requests a trial by jury and seeks judgment for a sum of money equal to back pay and benefits she is owed since the date of injury; compensatory damages; punitive damages; attorney’s fees and costs, as well as all court costs and expenses and any other damage or expense or fee allowed by law; reinstatement or front pay; and such other and further relief as thiseourt deems proper.
