WINFIELD — A couple's lawsuit against Leroy Lovejoy and Love Lee Construction alleges negligence, improper construction, fraud and misrepresentation.

Jason Hale and Lori Hale of Red House filed a complaint on June 3 in Putnam Circuit Court against the defendants, alleging that they failed to comply with applicable state and federal standards and regulations.

According to the complaint, the plaintiffs allege that last October, Jason Hale and Lori Hale discovered that their bathroom was improperly constructed. As a result, they say they sustained damages including but not limited to loss of value of their home and loss of use, and will incur future remodeling expenses. The plaintiffs hold the defendants responsible because they allegedly failed to construct the subject bathroom in a workmanlike manner, fraudulently claimed that the damage was due to normal wear and tear, fraudulently covered up the true nature of the problem and failed to rectify the defects.

The plaintiffs request a trial by jury and seek judgment against the defendants in an amount that will properly compensate them, attorney's fees and costs and such further relief as the court may deem fit and proper. They are represented by Maggie Kuhl of The Kuhl Law Office PLLC in Hurricane.
