Fuel supplier claims bill unpaid

HINTON — An energy suppler is suing McBride Family Enterprise LLC, citing alleged failure to pay for purchased products.

R.T. Rogers Oil Company filed a complaint on June 6 in Summers Circuit Court against McBride Family Enterprise LLC, alleging that the defendant failed to comply with the terms of a payment agreement.

According to the complaint, the plaintiff alleges that, between May 2013 and November 2015, it provided fuel to the defendant on an open account relationship. The plaintiff holds the defendant responsible for allegedly failing to pay the sum of $40,638.43.

The plaintiff requests a trial by jury and seeks judgment against the defendant for the unpaid balance of $40,638.43, attorney's fees and costs and for such other relief as the court deems just and proper. It is represented by James R. Sheatsley of Gorman, Sheatsley & Co. LC in Beckley.
