Mechanic says defendants responsible for injuries

BECKLEY — A mechanic is suing J.P. Techmical Services Inc., Pioneer Fuel Corporation and Alpha Natural Resources Services LLC, alleging negligence and insufficient measures taken to prevent injuries.

Shawn Osborne filed a complaint on June 16 in Raleigh Circuit Court against the defendants, alleging that they failed to comply with state and federal statutes and regulations.

According to the complaint, the plaintiff alleges that on June 16, 2014, he and his supervisor were conducting maintenance service on the defendants' CAT truck when it rolled forward and crushed his lower right leg and foot, causing severe and permanent injuries that resulted in physical pain and suffering, mental anguish, physical impairment, loss of wages and benefits and medical expenses. The plaintiff holds the defendants responsible because they allegedly exposed him to a high risk of serious injury and death, failed to provide him with equipment in safe and proper working conditions, failed to provide proper training, failed to provide supervision and assistance and failed to ensure that their equipment was secured.

The plaintiff requests a trial by jury and seeks judgment against the defendants for compensatory damages, attorneys' fees and costs, pre- and post-judgment interest, and any other relief the court deems just and proper.
