CHARLESTON — A woman is suing Sears Holdings Corporation and KMart Holding Corporation, alleging negligence and insufficient measures taken to prevent her from falling.
Sharon Humphreys filed a complaint on May 24 in Kanawha Circuit Court against the defendants, alleging that they failed to keep and maintain premises in a safe condition.
According to the complaint, the plaintiff alleges that on Jan. 22, 2015, she was seriously injured at the defendants' Kmart in Charleston, when she slipped and fell when she stepped on a loose piece of metal on the floor. She claims the incident led to medical expenses, great pain of body and mind, loss of enjoyment of life and other impairments and disabilities. The plaintiff holds the defendants responsible because the defendants allegedly failed to examine the premises for unsafe or dangerous conditions, failed to correct any unsafe or dangerous conditions and negligently placed a loose piece of metal on the floor that was colored similarly to the floor.
The plaintiff requests a trial by jury and seeks judgment against the defendants for compensatory damages, together with pre- and post-judgment interest and costs. She is represented by Charles M. Love of The Love Law Firm PLLC in Charleston.
