Woman blames city for injuries

CHARLESTON — A woman is suing the City of South Charleston, alleging negligence and insufficient measures taken to prevent injuries and negligence.

Iris Ann Holmes filed a complaint on May 31 in Kanawha Circuit Court against the City of South Charleston, alleging that the city failed to keep a sidewalk in a safe and hazard free condition.

According to the complaint, the plaintiff alleges that on May 31, 2014, she was walking on a sidewalk next to D Street in South Charleston when she stumbled over uneven pavement and fell, causing her to suffer great pain, mental anguish, loss of capacity to enjoy life, annoyance, inconvenience and aggravation, in addition to requiring medical treatment. The plaintiff holds the defendant responsible because the city allegedly failed to place warning signs on the uneven pavement and failed to care for and properly maintain the sidewalk.

The plaintiff requests a trial by jury and seeks judgment against the defendant for compensatory damages, punitive damages, pre- and post-judgment interest, attorney's fees and expenses, and for such other relief as the court may deem fit and proper. She is represented by Samuel F. Hanna of Hanna Law Office in Charleston.
