Trucking firm, driver blamed in collision lawsuit

WHEELING — A man is suing Thomas Kelley II and Equipment Transport LLC, a driver and truck terminal operator, alleging negligence and insufficient measures taken to prevent injuries.

Wayne Short filed a complaint on June 24 in Ohio Circuit Court against the defendants, alleging that Equipment Transport negligently entrusted a vehicle to Kelley.

According to the complaint, the plaintiff alleges that on July 18, 2014, he was a restrained operator of a 2008 Ford F-150 pickup truck stopped southbound on State Route 7 at a railroad crossing in Martin Ferry, and that Kelly, operating a 2012 Peterbilt dump truck, rear-ended his vehicle with great force, causing him to sustain severe and disabling injuries that resulted in pain and suffering, mental anguish, aggravation, inconvenience, loss of wages and medical expenses. The plaintiff holds the defendants responsible because Equipment Transport allegedly recklessly hired, trained and/or failed to train, supervised and/or failed to supervise Kelley, who allegedly lacked the knowledge and capability to perform his duties in the operation of his vehicle.

The plaintiff requests a trial by jury and seeks judgment against the defendants, jointly and severally, for all damages, pre- and post-judgment interest, attorney fees and costs and for such other relief that the court deems proper.
