Woman seeks damages for fall into water meter

BECKLEY — A woman is suing Raleigh County Public Service District, a business entity, alleging negligence and insufficient measures taken to prevent injuries.

Kelli D. Tolliver filed a complaint on June 24 in Raleigh Circuit Court against Raleigh County Public Service District, alleging that the business entity breached its duty of care to keep its premises in a safe manner.

According to the complaint, the plaintiff alleges that on Jan. 25, 2014, she fell into a water meter owned and maintained by defendant, causing her to suffer serious injuries to her ankle, knee and back. As a direct and proximate result, she incurred medical expenses in excess of $8,400, she claims. The plaintiff holds Raleigh County Public Service District responsible because the defendant allegedly failed to take remedial actions to eliminate the dangerous, unsafe condition.

The plaintiff requests a trial by jury and seeks judgment against defendant for compensatory damages as such an amount may be justified by evidence. She is represented by Anthony M. Salvatorre of Hewitt & Salvatorre PLLC in Fayetteville.
