Man says theft-protection insurer refused to pay

LOGAN — A consumer has filed a class-action lawsuit against Innovative Aftermarket Systems LP, an insurance company, citing alleged unlawful sale of insurance and refusing to pay claims.

Justin Bare filed a complaint on June 28 in Logan Circuit Court against the defendant, alleging that the insurer violated the West Virginia Consumer Credit Protection Act.

According to the complaint, the plaintiff alleges that on Dec. 7, 2014, his vehicle was stolen and that he has suffered damages in the form of financial losses, humiliation, embarrassment,, annoyance and inconvenience. The plaintiff holds the defendant responsible because the defendant allegedly denied the claim as untimely based, and allegedly sold theft protection plans without a valid license

The plaintiff requests a trial by jury and seeks compensatory damages, refund of premium paid, penalties, attorneys' fees and costs, pre- and post-judgment interest and other relief as the court deems just. He is represented by Jonathan R. Marshall and Sandra Henson Kinney of Bailey & Glasser LLP in Charleston.
