Woman says phone calls violated law

WHEELING — A woman is suing Marc Sporn, Dylan Sporn, Amerco Group Inc., Gentech LLC and Medi Biotech LLC, citing alleged harassment and abuse.

Diana Mey filed a complaint on June 30 in Ohio Circuit Court against the defendants, alleging that they violated the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that on Aug. 7, 2013, she began receiving calls on her cellular telephone from the defendants with the intent of selling consumer products. She says the defendants' actions caused her to be annoyed, inconvenienced, harassed, bothered and angered. The plaintiff holds the defendants responsible because they allegedly repeatedly called her using an automatic telephone dialing system even though her phone number was continuously listed on the National Do Not Call Registry. They also used pre-recorded or artificial voice messaging, she claims.

The plaintiff requests a trial by jury and seeks judgment against the defendants for all damages, attorney's fees, costs, and any further relief that the court deems just and proper. She is represented by Charles R. Pinkerton of Pinkerton Law Practice PLLC in Morgantown.
