Woman says collection agency owes her money

Late 06

WINFIELD — A woman has filed a class-action lawsuit against Commonwealth Financial Systems Inc., a collection agency, citing alleged breach of contract.

Brandy Bowyer filed a complaint on June 24 in Putnam Circuit Court against Commonwealth Financial Systems Inc., alleging that the collection agency failed to comply with a confidential settlement agreement.

According to the complaint, the plaintiff alleges that, on July 25, 2013, she entered into a settlement agreement in which the defendant was to pay $44,000 in $1,500 increments with the final payment on or about January 2016. She says she is still owed $13,500. The plaintiff holds Commonwealth Financial Systems Inc. responsible because the defendant allegedly failed to make payments under the contract and the settlement agreement.

The plaintiff requests a trial by jury and seeks judgment against the defendant for actual damages plus costs and fees and such other relief as the court deems just and proper under the circumstances. She is represented by Benjamin Sheridan of Klein & Sheridan LC in Hurricane.
