Beckley couple accuses GM of selling faulty vehicle

BECKLEY — Two Beckley residents are suing General Motors LLC, a car manufacturer, citing alleged breach of warranty.

Tara and James England filed a complaint on June 30 in Raleigh Circuit Court against General Motors LLC, alleging that the car manufacturer violated its obligations under the West Virginia Code.

According to the complaint, the plaintiffs allege that on March 24. 2013, Tara and James England purchased a new 2013 Chevrolet Equinox. After the sale, they experienced repeated nonconformities with the motor vehicle warranty, which substantially impaired its use and market value, the suit claims. They were caused to suffer loss of use of their vehicle, annoyance, inconvenienced and expenses, they allege. The plaintiffs holds General Motors LLC responsible because the defendant allegedly failed to conform the new vehicle to to the warranty and failed to replace the vehicle.

The plaintiffs request a trial by jury and seek judgment against the defendant for revocation of acceptance and refund of the purchase price, costs of repairs, loss of use, attorney's fees and such other relief as the court shall deem appropriate. They are represented by Anthony M. Salvatore of Hewitt & Salvatore PLLC in Beckley.
