Woman says firm fired her as retaliation for taking leave

CLARKSBURG — A former property manager is suing PPG Management LLC, a property leasing management firm, citing alleged violation of the Family and Medical Leave Act.

Dana Sappington filed a complaint on July 6 in the U.S. District Court for the Northern District of West Virginia Clarksburg Division against PPG Management LLC, alleging that the property leasing management firm retaliated against her by terminating her employment for exercising her rights under the FMLA.

According to the complaint, the plaintiff alleges that 28 days after her return from FMLA leave, she was terminated from her employment on April 13. As a result, she has suffered lost wages and earning capacity, aggravation, inconvenience, embarrassment, humiliation, indignity, insult and emotional distress, the suit claims. The plaintiff holds PPG Management LLC responsible because the defendant allegedly interfered with her FMLA leave by failing to make an adjustment to the property unit leasing expectations.

The plaintiff requests a trial by jury and seeks judgment against the defendant for compensatory damages, liquidated damages, pre- and pos-judgment interest, attorney's fees and such other relief as the court deems fair, just and proper.
