Debt collector accused of harassment

HUNTINGTON — Two consumers are suing Onemain Financial Inc., a debt collector, citing alleged violation of telephone harassment statutes.

Ben and Cori Collins filed a complaint on May 25 in Cabell Circuit Court against Onemain Financial Inc., alleging that the debt collector violated the West Virginia Consumer Credit and Protection Act.

According to the complaint, the plaintiffs allege that Ben and Cori Collins received collection calls repeatedly from the defendant at unusual or inconvenient times with an intent to annoy, abuse or oppress them. They were also caused to suffer indignation and emotional distress. The plaintiffs holds Onemain Financial Inc. responsible because the defendant allegedly used unfair and unconscionable means to collect a debt and continued to communicate with them even after they informed the defendant they they were represented by a lawyer, and failed to disclose the name of the business making a demand for payment.

The plaintiffs request a trial by jury and seek compensation for all damages, attorney's fees and costs and such other relief as the court deems just and proper. They are represented by Benjamin Sheridan of Klein & Sheridan LC in Hurricane.
