Woman blames trucking company for injuries

WHEELING — A woman is suing Murray Trucking Inc., a trucking company, alleging that insufficient measures were taken to prevent injuries.

Cheryl Tuba filed a complaint on July 7 in Ohio Circuit Court against the company, alleging that it violated the West Virginia code.

According to the complaint, the plaintiff alleges that on July 7, 2014, her vehicle, a 2007 Hyundai Santa Fe, was violently struck by the defendant's commercial truck being driven by its employee, causing her to sustain serious injuries resulting in pain and suffering, mental anguish, emotional distress and medical expenses. The plaintiff holds Murray Trucking Inc. responsible because the defendant allegedly carelessly entrusted the truck to an employee who was not licensed to operate it, who then negligently and carelessly operated the vehicle.

The plaintiff requests a trial by jury and seeks judgment against the defendant for compensatory damages, pre-judgment and post-judgment interest and such other relief as the court deems just and proper. She is represented by Justin M. Hershberger of Hershberger Law Office in Wheeling.
