Wrongful death claim alleges negligence at hospital

BECKLEY — A personal representative of a deceased woman's estate is suing Appalachian Regional Healthcare Inc. d/b/a Beckey Appalachian Regional Hospital, and hospital administrator Rocco Massey in a wrongful death suit alleging negligence in hospital care.

James Oaks, as personal representative of the estate of his spouse, Patricia Oaks, filed a complaint on June 30 in Raleigh Circuit Court against the defendants, alleging that they failed to implement appropriate policies and procedures to maintain the well-being and health of Patricia Oaks.

According to the complaint, the plaintiff alleges that between May 28, 2014 and June 9, 2014, Patricia Oaks was a patient at the defendants' facility when she suffered injuries that ultimately contributed to her death. The plaintiff holds the defendants responsible because they allegedly failed to provide a safe environment, intentionally understaffed the facility for financial gain and negligently hired, retained, trained and supervised their employees who cared for Patricia Oaks.

The plaintiff requests a trial by jury and seeks judgment against defendants for damages allowed by law, punitive damages, attorneys' fees, and any other relief the court sees fit to award.
