Wayne Co. golf course operators accused of not paying note

WAYNE — A commercial bank is suing The Silo Golf Course LLC and Mark B. Pinson, golf course operators, citing alleged breach of contract.

The Ohio Valley Bank Company filed a complaint on June 15 in Wayne Circuit Court against the defendants, alleging that they failed to perform their obligations under a commercial promissory note.

According to the complaint, the plaintiff alleges that it has suffered damages for not receiving payment for a total payoff balance of $1,027,585.87. The plaintiff holds the defendants responsible because the defendants allegedly have defaulted under the terms of the note by failing to make payments when due.

The plaintiff requests a trial by jury and seeks judgment against defendant jointly and severally, in an amount of $1,038,994.77, pre- and post-judgment interest, attorneys' fees and for other relief as the court deems just and appropriate. It is represented by Jame W. Lane, Jr. and Bradford P. Bury of Flaherty Sensabaugh Bonasso PLLC in Charleston.
