Car manufacturer, dealer accused of warranty breach

PINEVILLE — Two Wyoming County residents are suing General Motors LLC and Beckley Buick-GMC Auto Mall Inc., a car manufacturer and dealer, citing alleged breach of warranty.

Leroy Rasnake and Linda Rasnake filed a complaint on July 5 in Wyoming Circuit Court against the defendants, alleging that they violated provisions of the West Virginia Code.

According to the complaint, the plaintiffs allege that on Sept. 15, 2015, they purchased a new GMC Sierra 1500 truck. The suit alleges that after the purchase, the vehicle was subjected to service inspections and/or repairs on numerous occasions, but the vehicle remains out of conformity, in a condition is likely to cause a accident, causing the plaintiffs to suffer damages for loss of the vehicle's use, annoyance and inconvenience. The plaintiffs hold the defendants responsible because they allegedly failed to adequately redress the problem and failed to repair the subject vehicle to conform it to the express warranties.

The plaintiffs request a trial by jury and seek declaration of proper revocation of acceptance, an award for damages not limited to the purchase price of the vehicle, attorney's fees, costs and other relief as may be deemed appropriate.
