Woman says doctor was negligent in hysterectomy

HUNTINGTON — A woman is suing the federal government, alleging negligence and insufficient measures taken to prevent injuries.

Lori Goodman filed a complaint on July 1 in the U.S. District Court for the Southern District of West Virginia against the United States of America, alleging that the its employee, Dr. Andrea Kellar, failed to exercise ordinary care under the circumstances.

According to the complaint, the plaintiff alleges that between May 19, 2014 and Aug. 18, 2014, she experienced urinary incontinence and painful urination after undergoing a hysterectomy by Kellar. On or about Oct. 7, 2014, Dr. Charles Woolums discovered a stitch/hole in her bladder, she alleges. She claims negligence by Kellar caused her to suffer physical and emotional pain and to lose time from work, resulting in loss of income. The plaintiff holds the United States of America responsible because its employee, Kellar, allegedly inserted a suture through her bladder wall that she failed to discover, failed to recognize surgical planes between her bladder and uterus and failed to timely remove the misplaced bladder suture.

The plaintiff requests a trial by jury and seeks judgment for damages, pre-judgment and post-judgment interest, attorneys' fees, costs and other assorted damages. She is represented by Debra A. Nelson of The Nelson Law Firm LLC in Cincinnati.
