Ohio company claims unjust enrichment

BECKLEY — An Ohio corporation is suing Orchard Coal Company and Regan & Sierra Management LLC, citing alleged unjust enrichment.

Corky West Electric Inc., d/b/a CW Electric Inc., filed a complaint on July 7 in Raleigh Circuit Court against the defendants, alleging that they breached their duty to pay for materials and services provided.

According to the complaint, the plaintiff alleges that it was not paid for labor, equipment and materials it furnished to defendants in the sum of $65,125. The plaintiff holds Orchard Coal Company and Regan & Sierra Management LLC responsible because the defendants allegedly failed to pay for the reasonable value of the work, labor, services and materials rendered.

The plaintiff requests a trial by jury and seeks a judgment to have a lien on the property, an award for damages, pre- and post-judgment interest, attorney's fees and costs and any other relief the court may deem just and appropriate. It is represented by Justin D. Jack of Flaherty, Sensabaugh & Bonasso PLLC in Charleston.
