Certified nursing assistant claims retaliatory termination

WHEELING — A certified nursing assistant is suing Good Shepherd Nursing Home LLC, a former employer, citing alleged wrongful termination.

Karen Melott filed a complaint on July 6 in Ohio Circuit Court against Good Shepherd Nursing Home LLC alleging that the former employer violated the public policies of the State of West Virginia.

According to the complaint, the plaintiff alleges that she was harassed and mistreated, and was caused to suffer emotional distress, annoyance, inconvenience, humiliation, embarrassment and economic harm. The plaintiff holds Good Shepherd Nursing Home LLC responsible because the defendant allegedly knew that a newly hired nurse's aide harassed and mistreated her, and also because the defendant allegedly terminated her employment in retaliation for exercising her protected rights and responsibilities.

The plaintiff requests a trial by jury and seeks compensatory damages, punitive damages, pre-judgment interest, attorney's fees, costs and such other relief as the court deems appropriate. She is represented by Nichola A. Wininsky of Wininsky Law Offices in Pittsburgh.
